Emails confirm Hicks won't get fair trial: lawyer. :
"A lawyer for Australian Guantanamo Bay detainee David Hicks says new revelations from two former US military prosecutors prove that the process being used to try his client is biased."
This lawyer is really on the ball and if I wanted a lawyer, he'd be the man for me. He is very alert. But emails or no emails, international lawyers and experts in international law had said that this form of commission does not meet the requirements of international law. David Hicks , like so many other people, was out in Afghanistan before all the stuff which now colours our thinking about what people call terrorism and terrorists. This is the opposite of a pre-emptive strike. A retrospective slug. On the one hand , America has the right to protect itself from those it would see as being people who would pose a threat to its security and well being and would want to deter anyone from fighting against them.On the other, David Hicks was in Afghanistan when America did not feel threatened. I just think a whole heap of distance and neutrality needs to come to bear on this case, but his lawyer seems to be completely au fait. It would be good to see the facts relating to David Hicks. All we know, basically, is that David Hicks was fighting in Afghanistan when he was captured by Americans. It's another one of those vague, blurry stories.
